2. Scope of services

Optima Pack provides custom packaging solutions, including but not limited to:

• Custom printed packaging (cups, bags, boxes, takeaway packaging)
• Design and prepress services
• Production and delivery of made-to-order products

All products are manufactured based on customer specifications.

3. Business customers (B2B)

Our services are primarily intended for business customers (B2B).

If a purchase is made by a consumer (B2C), mandatory consumer protection laws shall apply where required and shall prevail over these Terms where applicable.

4. Order process and contract formation

The order process follows these steps:

1. Product selection and request
2. Quotation (if applicable)
3. Design creation and/or submission
4. Design proof provided for approval
5. Customer approval
6. Payment
7. Production
8. Delivery

A binding contract is formed only after:

• Final design approval, and
• Order confirmation and/or payment (as applicable)

Design approval constitutes full acceptance of all specifications and makes the order final and non-cancellable.

5. Pricing and payment

5.1 Pricing

Prices may vary depending on:

• Quantity
• Materials
• Custom specifications
• Printing requirements

We reserve the right to modify prices at any time prior to order confirmation.

5.2 Payment terms

• Payment may be required in advance (full or partial)
• Orders may not enter production until payment is received

5.3 Payment default

We reserve the right to:

• Suspend or cancel orders
• Delay production or delivery

in case of non-payment or delayed payment.

6. Design and intellectual property

6.1 Customer responsibility

The customer:

• Retains ownership of submitted artwork
• Guarantees they have full legal rights to use all logos, trademarks, and content provided

Optima Pack shall not be liable for any intellectual property infringement resulting from customer-provided materials.

6.2 Use of materials

Unless otherwise agreed, Optima Pack reserves the right to:

• Use produced designs and products for portfolio and marketing purposes

7. Design approval and artwork responsibility

Before production, a final design proof is provided.

By approving the design, the customer:

• Confirms all details are correct (text, colours, layout, dimensions)
• Accepts full responsibility for any errors

Optima Pack is not responsible for:

• Typographical errors
• Design mistakes
• Incorrect information approved by the customer

8. Production and lead times

All production timelines are estimates only.

We are not liable for delays caused by:

• Production constraints
• Supplier issues
• Logistics or transport delays
• External factors beyond our control

9. Delivery and risk transfer

Delivery is performed via third-party couriers.

Risk transfers to the customer:

• Upon delivery of the goods to the courier

Optima Pack is not liable for:

• Delays caused by shipping carriers
• Losses occurring after dispatch

10. Product specifications and tolerances

Due to industrial manufacturing processes, the following are acceptable and do not constitute defects:

• Colour variations (CMYK vs Pantone vs digital previews)
• Material and finish differences
• Minor size deviations
• Print alignment tolerances

11. Quantity tolerance

Delivered quantities may vary by ±1% to ±5%.

Such variation is standard in production and shall not constitute grounds for claims or refunds.

12. Product use and compliance

The customer is solely responsible for:

• The intended use of the products
• Compliance with local regulations (including food contact, labeling, and safety requirements)

Optima Pack does not guarantee suitability for specific uses unless explicitly agreed in writing.

13. Returns and refunds

All returns, claims, and refunds are governed by our Return & Refund Policy, available on our website.

14. Limitation of liability

To the maximum extent permitted by law, Optima Pack shall not be liable for:

• Indirect or consequential damages
• Loss of profit, business, or opportunity
• Delays or failures caused by third parties

Our total liability is limited to the value of the affected goods.

Nothing in these Terms shall exclude or limit liability where such limitation is not permitted by law.

15. Force majeure

We shall not be liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to:

• Natural disasters

• Supply chain disruptions

Optima Pack reserves the right to update, modify, or revise these Terms & Conditions at any time.

Changes become effective upon publication on optimapack.eu.

The version applicable to an order is the one in force at the time the order is placed.

17. Governing law and jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Romania.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Romania.

By placing an order on optimapack.eu, the customer confirms that they: have read, understood, accepted these Terms & Conditions in full.
